Barry Young Misleads Judge Davis Over Chart Locations
Bolton moves on from the Barry Young’s Yawing debacle –
“We have agreed that at the starting point of the course of 286* at the Sth end of Motuihe the course of 286* comes to a point on the Nth Shore south of the conspicuous building.”
Judge Davis – “ I don’t know that that was necessarily agreed. I think he was accepting there was a course of 286*, I don’t think he necessarily agreed that there was a point or that course necessarily began where you were saying the ferry first turned if you’re trying to identify a specific point in the harbour because Mr Young’s evidence was there were no plotting or anything like that that were available, in fact he specifically rejected your science shall we say, as to where the ferry may have turned, as I understand it?”
Bolton – “Well, taking the same point at the Sth end of Motuihe, we know the course of 286* comes South  of the conspicuous building. When you line up that point at the Sth end of Motuihe to the conspicuous building that is 292*.”
Judge Davis – “Yes but I don’t know that any of that was actually, when you say it was agreed I don’t think it was agreed at all.
I think his entire evidence was disagreeing with your science Mr Bolton?”
Time was running out & considering  Judge Davis’ lack of nautical knowledge
Bolton said – “Well it’s just a very simple navigational practice, there’s nothing to really argue about.”
This is another example of the miscarriage of Justice caused by the misleading of Judge Davis by Barry Young ignoring his Code of Conduct as Expert Witness to be helpful to the Court in preference to acting as Hired Gun for Maritime New Zealand.
Judge Davis was relying on Barry Young to honestly answer matters of a navigational nature & although Judge Davis had M Pigneguy’s evidential chart on which he’d drawn his turning point at Sth Motuihe, Judge Davis could not read a chart. It was deliberately deceptive of Barry Young to lead Judge Davis to believe that there was no starting point for Seaway’s course of 284* or 286* as the course moved up to about 2nmiles prior to the taking of Photo 1
