Barry Young breaks his sworn Code of Conduct for a purported Expert Witness as he denigrates Bolton’s “Infallible Rule of Thumb” without giving any reason for his opinion which appears solely for the purpose of supporting Maritime New Zealand’s case.
He states in his Brief of Evidence – “Mr Bolton on Classique believed that there was no risk of collision & that Seaway would pass well clear to Classique’s starboard side. He came to that conclusion by using what he calls an “Infallible Rule of Thumb” which involved watching the coastline behind Seaway to assess risk of collision. I should state that in my opinion this method is flawed & is dangerous & can lead to incorrect conclusions. I make no comment about whether Mr Bolton’s conclusion with regard to the risk of collision in this incident was incorrect but merely point out that his method of determining risk of collision was unreliable & should never have been used.”
Barry Young is revealing abysmal knowledge of a basic age old navigational principle which is so accurate that it can be regarded as “Infallible”. His code of conduct demands that he gives reasons for opinions – he not only fails to do that & he would not be able to but he then makes no comment as to whether Bolton was correct or not in determining risk of collision. Bolton was correct & it was M Pigneguy who used a most inaccurate Relative Bearing method which was nefariously backed by Barry Young.
This Line of sight method can be checked for accuracy when anyone ashore steps off the pavement intending to cross a road with oncoming traffic – when a car appears to progressing on the background, it will pass in front of the pedestrian – when appearing to recede on the background the car will pass behind the pedestrian. Similarly when crowds are crossing at an intersection such as on Queen St Auckland, it is easy to determine passing clearance either behind or in front. Similarly crews on racing yachts soon learn this fundamental practice – they haven’t got compasses at the ready but often have to monitor many vessels simultaneously with accuracy & speed.
When the method is studied, it replicates the movement of a compass bearing – it’s either increasing, reducing or remaining constant, in which case there would be no clearance & avoidance would be in order. It has an advantage over a compass in that the bearing is extended & amplified like a spoke of a wheel moving more at the rim compared with at the hub. Furthermore many objects can be monitored rapidly in conditions rendering a compass impractical. In fact this is how navigators can manage without a compass being available.
Barry Young who purports to have navigational experience appears to deliberately mislead Judge Davis as to a basic & accurate navigational method which is taught in Maritime Schools & explained in Nautical text books.
