Barry Young reveals he has no conscience when he fabricates his Brief of Evidence – “After taking measurements aboard Seaway, I estimate that Classique passed within 25 mtrs of Seaway. This is a dangerous passing distance under the circumstances because large, heavy vessels like Seaway can be difficult & slow to turn or stop in an emergency. It is therefore particularly important that smaller vessels, which are obliged under Part 22.15 to keep out of the way, should give larger vessels a wide berth.”
1: Barry Young’s measurements were taken when Seaway was at her facilities at Half Moon Bay, stationary, ramp resting ashore & unladen with a sloping beach onto which his measurements were projected.
2: Not only that but the protrusion on the bow of Seaway, which M Pigneguy used in his Relative Bearing, was said to be against the hull of Classique in photo3 – it was not & an enlarged Photo shows it to be several mtrs off
3: In addition, the Photo 3 was zoomed, distorting the appearance of proximity, so Barry Young’s measurements were used deceptively to mislead Judge Davis.
4: The clearance observed from Classique & confirmed by staff at Auckland Harbour Master’s office from photo 3, was 50 to 80 mtrs.
5: If it was a dangerous passing distance, it was created entirely by M Pigneguy to manufacture an incident to photograph for the Court.
6: Seaway was not as Barry Young described to suit his role of being Hired Gun for Maritime New Zealand – it was according to M Pigneguy, a Highly maneuverable craft, quick to stop with 2 engines & 4 propellers in its catamaran hull.
7: There’s nothing in Maritime Rules part 22 – collision prevention, to suggest that size of vessel has any part to play. Might is not necessarily right & M Pigneguy violated the intent of collision regulations by creating the situation he wanted – close quarters so he could take his photograph.
