Barry Young was not being helpful to the Court in accordance with his Sworn Code of Conduct as a purported Expert Witness. He has not reported in his Brief of Evidence the true facts of the situation.
He writes in his role as Hired gun for Maritime New Zealand –
“By failing to take early & substantial action to give-way, Classique caused a close quarters situation to develop, there by causing unnecessary danger to those aboard Classique & Seaway. In the end Classique passed dangerously close ahead of Seaway – in breach of the requirement of the last part of Rule 22.15 to avoid crossing ahead.
The Facts of the situation from a more realistic point of view follow –
1: Classique was not a give-way vessel obliged to take any action early or otherwise because of the approach of Seaway
2: Classique did not cause a close quarters  situation to develop, nor cause any danger to itself or Seaway.
3: In the end it was Seaway which passed which passed unnecessarily close to Classique by steering incrementally over the passage of 2 nmiles towards the path of Classique
4: This was in breach of Maritime collision regulations which are designed to prevent the very situation M Pigneguy caused by his negligent & preconceived actions – to entrap Classique & record photographic evidence in the process of pedantically educating his trainee watchman Phillip Sweetman in how to prepare  for the prosecuting of supposed Ignorant recreational boaters.
5: Any danger caused by the nefarious actions of M Pigneguy was solely for the dramatic impression he aimed to create in Court for an unwitting Judge Davis. The clearance was easily adjustable by M Pigneguy if he chose. Bolton was monitoring the Rogue behavior of M Pigneguy & was ready to increase the amount of clearance if it was further reduced.
6: Rule 22.15 didn’t apply in this situation where there was no risk of collision until M Pigneguy’s incremental turning towards the path of Classique reduced the earlier 460 mtrs available clearance.
7: Barry Young could’ve quoted in relation to M Pigneguy’s violation which caused the close quarters,  Rule 22.8.2 –“A succession of small alterations of course or speed should be avoided”.
