He has a section in his Brief of Evidence  “Requirement for Stand-on vessel to maintain course” He commences – “The requirement under Part 22.17.1 for the stand-on vessel to keep its course is of particular importance in this incident because of Mr Bolton’s claim that Seaway failed to comply with this requirement. Mr Bolton alleges that during the incident, Seaway changed its course to starboard from a heading of 286 degrees True to a heading of 297 degrees True – a total of 11 degrees.”
Barry Young then in typical devious fashion describes how he worked out how much Seaway “drifted” to starboard.
1: The term “drift” used, is blatantly misleading to Judge Davis who is unfamiliar with nautical terms. There was no chance that Seaway “drifted” in flat, windless, currentless conditions.
Barry Young used the word “drifted” 3 times which indicates a dishonest intention to pervert the course of justice.
2:  Seaway turned starboard incrementally either deliberately or inadvertently because of the negligence of M Pigneguy to steer a straight course. Neither M Pigneguy nor Phillip Sweetman, his trainee watchman checked Seaway’s course at any time during Seaway’s passage from the point Seaway turned at Sth Motuihe in the direction of Classique’s path. No electronic verification was provided by M Pigneguy to back up any course he said he was on.
3: The method Barry Young used to determine Seaway’s turning was convoluted & inaccurate, probably to give him a miniscule figure of 2.4 Degrees within the 3 Photos which suited his purpose of denying the facts which must also include the turning Seaway did before Photo 1 to be the sensible & total correctly 11 degrees.
4: Barry Young acted as if he was incompetent to be regarded as an Expert witness when he said he couldn’t work out how much Seaway turned prior to Photo 1. He conveniently forgot all the evidence M Pigneguy had supplied including an exact location at Sth Motuihe where Seaway turned towards Classique.
5: If Barry Young knew anything about navigation he would’ve been able to use a plotter or the compass rose on a chart to determine the heading of Seaway.
6: Barry Young said he had been out to the area in his own boat. He could have gone to that location at Sth Motuihe as Bolton did & steered a 286* course noting that it came to a point close to where Classique appears in Photo 1 with a background of the white cliffs – well South of the tall Sentinel  building M Pigneguy said he was steering to.
7: It was also presumptuous of Barry Young to classify Seaway as a stand-on vessel, disregarding all the evidence that there was no stand-on/give-way vessel until M Pigneguy unilaterally & in violation of Maritime collision regulations altered the category of approach by his own negligent actions.
