This evidence given is unfortunately held by Judge Davis to be valid information –
“Captain Pigneguy reported what he considered to be a close quarters situation to Maritime New Zealand & an investigation was conducted. As part of that investigation the photos were analyzed by Maritime New Zealand & by an independent witness whose evidence was that Classique passed between 18 & 30 mtrs across the bow of Seaway, a distance that in his view was not safe”
Considering this case was a frame up to prosecute Bolton – M Pigneguy, Maritime New Zealand & Barry Young fabricated the information towards that end –
1: M Pigneguy reported the close quarters he manufactured for the purpose of giving Maritime New Zealand something to act on.
2: Maritime New Zealand went through the motions of conducting an investigation just as a formality with no intention of finding out the facts of the unfeasible & impossible claim made by M Pigneguy.
3: Maritime New Zealand made a farce of analyzing the photos which show clearly the violation of M Pigneguy in steering incrementally towards the path of Classique.
4: The purported expert was not only deficient in his navigational capabilities but blatantly dishonest in denying valid navigational methods & principles. Furthermore Barry Young acted as a Hired Gun for Maritime New Zealand’s case rather than independent & helpful to the Court as his Code of Conduct requires.
5: Barry Young’s assessment of the clearance at passing was nowhere near accurate – He did his measurements when Seaway was back at its base in Half Moon Bay. Seaway was stationary, unladen with its ramp resting on land, he was viewing from a sloping beach, his measurement from Classique was estimated from a zoomed photo & a marker on board Seaway was several mtrs from the position stated as against the hull of Classique.
6: Viewed from Classique on the day & verified by Harbour Master office staff from M Pigneguy’s photos, the clearance was 50 to 80 mtrs.
7: Regardless of estimates, the clearance was that left by M Pigneguy after he negligently reduced it from 460 mtrs & he must have considered it to be safe enough for his nefarious passage.
