As much as Judge Davis sounds as if he knows what he’s writing about, he’s reiterating the wrongful evidence given by Barry Young who was acting as the Hired gun for Maritime New Zealand.
“The 3 photos taken by Captain Pigneguy quite clearly demonstrate that a crossing situation was developing & the onus was on Mr Bolton to have kept out of the way in accordance with the rules.”
Judge Davis had admittedly no nautical knowledge & was unable to determine anything from his own observation of the photos taken by M Pigneguy as he manufactured the unnecessarily close quarters to harass Bolton on his peaceful passage to SW Motuihe.
1: The photos show more than a crossing situation was developing, they showed it was M Pigneguy violating Maritime Rules by incrementally steering towards the path of Classique – as evidenced by the heading of Seaway turning from 284*, past 286* & to 295* at the taking of Photo 1, then to 297* by Photo 3.
2: The onus was on M Pigneguy to go back to his earlier courses or alternatively, adhere to the course his Regular Run would take around Browns Island enroute Auckland.
3: Bolton was keeping a steady course monitoring the Rogue ferry & prepared to take action if the clearance was further reduced.
4: Therefore M Pigneguy unilaterally altered the category of approach of Seaway in violation of Maritime Rules & was not entitled to invoke the crossing rule by his own negligent action.
