Keith Ingram’s Roll of Dishonour & Phillip Wardale’s Trespass Notice inconceivably forgotten by Judge Davis along with all their interconnecting relationships.

It makes a mockery of what is expected of our Judicial system when the Judge fails in what might be called his job to keep a track of the facts given to him in evidence.
Judge Davis writes in his misguided Decision –
“Bolton suggested in Court that there was a conspiracy by members in the Maritime fraternity to bring this prosecution against him, notwithstanding the witnesses for the prosecution did not know either of the conspirators that Mr Bolton suggested had put the witness up to the prosecution.”
This is another example of the lack of grasp of what went on before Judge Davis apart from his acceptance of Barry Young’s nonsensical evidence.
1: Bolton gave Judge Davis a copy of the Role of Dishonour created by Keith Ingram, editor of Professional Skipper Magazine
for the purpose of having Classique as its prime target in 2006. Even though its claim was without foundation, it remains today.
2: Keith Ingram was subpoenaed but was excused by the Court.
3: M Pigneguy gave evidence in Court that he was a personal long term friend of Keith Ingram & a contributing author to the Professional Skipper Magazine bursting to get this case won.
4: Keith Ingram’s emails about Bolton & Classique to Ian Howden, Maritime New Zealand were included in the Disclosed Documents provided to the Court. He had been pressuring MNZ for years.
5: Phillip Wardale, Manager of Bayswater Marina was also subpoenaed & turned up to wait his turn until being told by Crown Law he wasn’t required & Judge Davis was informed of his unseemly behavior during the interim.
6: Judge Davis had a copy of the trespass notice Phillip Wardale issued Bolton in 2008 in defiance of the Marina’s resource consent regarding vessels moored outside the Marina. Phillip Wardale did not want to be seen by his Charter boat berth holders to be assisting Bolton & was extremely antagonistic towards him.
7: Judge Davis listened to Ian Howden explain in cross-examination how Phillip Wardale had an arrangement to notify Ian Howden each time Bolton booked Marina space before each off shore voyage. There were more than 16 over the years. Ian Howden & perhaps Jim Lott as well, would be onboard Classique each time to verify that each crew understood its status.
8: M Pigneguy also gave evidence to Judge Davis that he was the ex chairman of the Charter Boat Association who had this controversy regarding Classique’s Cost Share Crew Concept.
