It seems incredible that grown men with the purported experience of those in positions of authority at Court involved in this case, ignore the zoom effect on distance in photography.
Judge Davis showed complete ignorance of the matter when he wrote in his Decision
“Mr Bolton alleged that the photos taken by Captain Pigneguy had been altered. Ironically Mr Bolton himself attempted to tender into evidence photos that he had altered on his computer.
I accept that Mr Bolton did not attempt to hide the fact the photos had been altered – he said as much himself.”
This is all Judge Davis had to say about the zooming of photo 3 by M Pigneguy to create the appearance of exaggerated proximity to nefariously amplify his claim of close quarters.
1: Bolton noticed immediately he saw the photos, that photo 3 had a distorted impression of clearance as compared with that seen from Classique on the day.
2:Bolton discovered that indeed Photo 3 had been zoomed & this was shown to Ian Howden & Jim Lott during the first interview.
3: The measurement of Seaway in photo 3 differs from that in Photos 1 & 2 but both Ian Howden & Jim Lott chose to ignore it.
4: M Pigneguy admitted in his cross-examination that he had zoomed photo 3 – brushing it off as if it didn’t matter.
5: Barry Young also disregarded the effect it would have on the illusion of close quarters
6: Judge Davis although he admits to having no nautical knowledge could conceivably have had a personal understanding of the function of the zoom control but in the absence of that, went along without foundation to write off a deceptive attempt by the prosecution to create misleading evidence.
7: The misconstrued understanding Judge Davis had of the altered photo 3 Bolton presented is typical of the way he handled all of Bolton’s evidence.
8: Bolton during his explaining of the effect zooming had on the amount of water between the vessels in photo 3, showed a photo 3 with the high side of Seaway digitally erased to reveal a lot more water. The unusual design of Seaway with its wheelhouse over to port instead of centre also brought a distortion of perspective compared with that of a normal construction.
