Barry Young’s Mental Capacity Already Affected At The Trial?
During a status hearing at the District Court, (to determine how matters look prior to proceeding to a Trial) Judge Simpson recommended that Maritime New Zealand & Bolton sort matters out between themselves to save waste of Court time.
Maritime New Zealand delayed arranging a meeting at Crown Law offices for about a month while Barry Young recovered from what was said to be a leg problem – he was to be their nautical expert.
Alysha McClintock, a young Crown Lawyer, at the opening of the meeting blatantly disregarded Judge Simpson’s instructions & said all they would do was listen to Bolton’s evidence & take his diagrams, plots etc but enter into no discussion at all. Maritime New Zealand would notify Bolton in due course as to their decision to proceed to trial.
Barry Young was employed at the Maritime Nautical School at that time & Bolton heard from Julian Joy, chief Instructor at the same school, that Barry Young had advised Maritime New Zealand not to proceed to trial.
Notwithstanding that advice Maritime New Zealand didn’t withdraw their prosecution & Barry Young accepted employment as their Hired Gun, leading the Court to believe he was a an Expert Witness, swearing to up-hold a Code of Conduct primarily being an independent help to the Court.
Immediately Barry Young then had a conflict of interest & unfortunately acted throughout the trial with no regard for his personal or professional integrity.
Perhaps the onset of whatever was ailing him at that time began to cloud his judgment. Throughout the trial he was uttering statements quite contrary to logic & denying basic navigational practice.
This was an otherwise educated man, standing up in public & making a nonsense of himself in front of the Court & those attending.
Julian Joy & students of the Maritime School were attending out of professional interest in the case which had no merit & yet was pushed in front of a nautically uneducated District Court instead of being notified to TAIC – Transport Accident Investigation Commission, as mandatorily required.
TAIC was set up by an act of parliament specifically to investigate incidents such as the one M Pigneguy complained about. The reason being that lessons may be learned & passed on to the boating community to avoid similar misadventure happening in the future.
Unfortunately the outcome of Judge Davis’ erroneous decision based on the dishonest & misleading evidence of Barry Young, has misinterpreted Collision Regulations especially in areas where ferries have Regular Runs.
