8 – The matter was heard in Auckland District Court by Judge Davis. Throughout the process, Mr Bolton represented himself & Maritime New Zealand was represented by Mr Davies of Crown Law, Meredith Connell.
9 – Judge Davis issued Reserved Judgment, finding Mr Bolton guilty on charge one & dismissing the other charges. (See #6)
10 – Prior to sentencing, Mr Bolton lodged an appeal & arranged Legal Representation.
11 – In the informant’s sentencing memo, it was submitted that a fine of $6000 & costs should be awarded. No fine of that size has been given & most close quarter situations of a far more serious nature than this incident have resulted in censures by MNZ rather than in prosecutions.
12 – In the informant’s sentencing memo, it quotes cases that are not similar cases. They are cases in which actual harm was done, collisions or groundings occurred & people were harmed. In these, the fines were small. These are not relevant here. More relevant are the many cases on the MNZ website for close quarter situations where the normal result is a ‘censure’
13 – At sentencing, Mr Eastwood represented Mr Bolton. Judge Davis agreed for Mr Eastwood to arrange to have Mr Joy appointed as an expert witness & for Mr Joy to review the incident & evidence & submit a report to the Court. Maritime New Zealand would have a month to respond.
