The last update 2 weeks ago 7th December’14, had reached the point where a Mooring Expert had been located with a very high Lloyds of London qualification.
He has now forwarded to the Legal Aid approved Lawyer, the figure he will charge for writing his report & his qualifications for approval.
The next step would have been for the Lawyer to forward that information to Legal Aid but Xmas holidays intervene & that probably won’t happen until mid January now.
A requirement of the Expert was to be provided with the original 2000 certificates approving the mooring specification for laying.
That would cover, type of equipment, weight, length, depth of water, holding capacity etc.
The Bi-annual inspection certificates are requested with the names of the contractors over the years. Perhaps there was only one contractor & he will be having to answer severe questioning as to his negligence. Obviously the Harbour master staff must have responsibility for the original approvals & keeping up with what the contractors are doing or not doing from time to time.
Although both the Claims manager & the Auckland Council Insurers have been asked this week, to locate these certificates, there has been no response, perhaps Xmas interval is already closing the offices down.
Meantime charges are mounting while Classique waits for Auckland Council to accept liability – all increasing the amount of claim they’ll eventually be having to meet.

The using of a fairly light one directional, single fluke anchor, laid upside down with dis-similar metals creating electrolysis to weaken the chain are several of the matters to be addressed.
