Bolton submitted that the course of 286* is to a point on the white cliff, closer to Classique as shown on M Pigneguy’s marked Photo in evidence.
M Pigneguy says in Trans Page 45/9 he altered course from 260* to 284* after rounding Sth Motuihe. That the ferry was lined up North of the Sentinel shows its course was already above 286* (aprox 292*)at the taking of Photo 1. There was further turning to 295* & 297* at Photos 2 & 3 (Attached marked 1)
(A) – References to AIS records not being available from the ferry are in Trans Pages 72 – 77. Having AIS records would’ve backed up M Pigneguy’s stated course but he avoids answering as to whether he had AIS & what its use would’ve been. Bolton’s first available copy of an AIS record of a ferry’s Regular Run is dated about 10 days after the incident. (Attached marked 2)
(B) – Bolton submits that the use of Transit lines & position lines to get an accurate fix of a vessel’s position was not understood by either M Pigneguy (Trans Page 63) or Barry Young (Trans Pages `180, 181, 182, 183) It is fundamental navigation practice for a single transit with one intercepting compass bearing position line to be sufficient. That in addition, Bolton’s position line was also a second transit is not recognized by either person & consequently Judge Davis is mislead as to evidence of Bolton’s plotting accuracy.

This deliberate misconstruing of basic navigational principles would not have fooled an appropriate forum such as TAIC – Transport Accident Investigation Commission which Maritime New Zealand illegally failed to notify.

An unskilled navigator can determine a course on a chart
with a compass rose if he has no more elaborate instrumentation.
