Bolton submits that the ferry, Seaway, approached Motuihe from Waiheke on a course of 260T. After rounding Motuihe, a course of 286T was gradually reached but the ferry had turned to 292T at the point of the taking of Photo 1 and then began heading above the Sentinel Building.
(A) M Pigneyguy gave in evidence (Trans Pages 11,12) as he turned at Motuihe “I could see the end of Rangitoto in transit with Spencer(Sentinel) in Takapuna.”
That is so at the point marked on his chart at Sth Motuihe but by the time of taking Photo1, the tall building is seen half way along the flat end of Rangitoto. The only way for that to happen is for the ferry to have steered an elliptical course over the 2 miles – by changing course at Motuihe from 260* & steering past 286* to 292* until the taking of Photo 1 & continuing up to 295* & 297* by Photo 3
(B) Neither M Pigneyguy nor Phillip Sweetman checked the ferry’s course leading up to the alleged incident. Phillip Sweetman didn’t see Pigneyguy take the GPS/Radar plot (Trans Page 121) & at the end of the day back in Auckland, they shared the data manufactured by M Pigneguy (Trans Page 120,122) The similarity of the 16 main points made in the Claim by M Pigneyguy and the Sworn Statement by Phillip Sweetman, lead to a clear inference that they are copied – incorrectly in the case Sweetman who confuses his “point of observation” with the “point of incident” (Trans Page 119)
