The following is the Appellant’s response to Paragraph 17
[11] Para 17 : His Honour has been mislead on Rule 22.15 Crossing Situation – crossing so as to involve risk of collision….
Bolton submits that this rule was not applicable in this situation where there was to be a safe crossing, or no crossing at all, without risk of collision.
(A) It is submitted that evidence reveals the Judge Davis says wrongly “No dispute there was no other traffic in the vicinity preventing Classique turning Starboard” His Honour has not been permitted by the Prosecution to take into account that Browns Island & Light with its reef is close along Classique’s starboard side.
(B) Trans Page 20 – “Pigneyguy says there was clear water for Classique to turn to starboard”
Page 208 – “Bolton’s says – I’ve got a keel on my yacht & I don’t go too close to Browns Light”
Seaway is a shallow draft catamaran drawing less than Classique. It is reluctant to turn towards Browns – refer Trans Page 72 line 27… “that would put me (Seaway) close to Browns Island.”
(C) Barry Young has not allowed proximity to Browns to be seen by the Court.
Trans Pages 182,183,184,185. Re Browns light & island, Barry Young says “I don’t think we can make that assumption” “I don’t feel comfortable making assumptions on things not showing on Photos” “I’ve discounted that.” Even though Photos were displayed by the Appellant showing an orthodox method of determining position (Attached 6)

Julian Joy in his Report shows how it is a navigator’s normal exercise to deduce from a photograph, the location in which it was taken. There was no other forum but this District Court with Judge Davis’s level of nautical knowledge, where Barry Young would get away with denying such a basic navigational principle.
