The following is the Appellant’s (Bolton’s) response to Paragraph 26
[17] Para 26 : His Honour it is submitted, misunderstood “rules & crossings”
(a) I (Bolton) did not deny there was a “Crossing” situation nor that Maritime Rules did not apply – but I did say that it was a “Crossing without risk of Collision where if both vessels had kept their course & speed, each would have passed clear of each other”
and that Rule 22.15 did not apply in this situation.
(b) It is submitted that Mr Pigneyguy violated Rules 22.7; R22.8; R22.17; R22.33(b)appendix3; R22.34.1.4; & R22.40 by improperly assessing risk, failing to keep his course & speed, failing to sound at the appropriate time adequate signals, thereby manufacturing an approach to appear at close quarters in violation of the ordinary practice of seafarers or the special circumstances of the case in a harbour situation involving a ferry on a regular run.
(c) The above is at variance with the view of the purported prosecution expert Barry Young & other witnesses such as M Pigneguy who were not acting in a manner helpful to the Court. Trans Page 237 : Barry Young as a Hired Gun for Maritime New Zealand dishonestly disagrees with it.
(d) References to “Crossing with no Risk of Collision”, passing clear of each other & “No crossing at all” are given above at [5] Para 11. Trans Page 36 – “Why did you think a crossing situation with ROC existed when if we’d both (ie, Seaway & Classique) kept our courses we’d have passed clear of each other…”

It is an absolute disgrace that an otherwise educated collection of individuals will apparently perjure themselves & pervert the course of Justice to hide the violations of M Pigneguy who was entirely responsible for manufacturing the close quarters to implicate the wrong skipper.
