The following is the Appellant’s response to Paragraph 33, c, d, e, f, g.
[23] Para 33 : His Honour it is submitted, has unwarranted conclusions
(c) There has been no official Maritime New Zealand report published. This would normally be a precursor to a prosecution, that not being considered unless there was vessel impact, severe damage & loss of life – certainly not for an implausible complaint surrounding Maritime New Zealand Collision Regulation Rule mis-interpretation, impinging the unblemished record of an internationally experienced mariner commercially certificated since 1977.
(d) We submit it was unethical that a Judge unfamiliar with Nautical Law & its application should be mislead by the prosecution & its witnesses to the extent that Rule 22 in its entirety is not understood by Judge Davis especially as to definition of types of “Crossings”. Rule 22.15 – some not involving risk of collision, special circumstances etc, which applied in this case with a ferry said to be on its Regular Run, which brings to the forefront of Risk Assessment & Management, proper Maritime practice & etiquette when blindly following the Rules is nautically imprudent.
(e) Trans Page 27 refers to Pigneguy being Auckland Charter Yacht Association ex chairman. (Consequently with objections to Classique’s Cost Share Cooperative Crew Concept)
(f) Trans Page 26, 27, 28, refers to Pigneguy’s association with Keith Ingram, editor of Professional Skipper Magazine.
Trans Pages 157, 158 refers to Ian Howden’s association with Keith Ingram & Phillip Wardale.
(g) Trans Page 152. Ian Howden hasn’t made any report on this investigation – only, Maritime New Zealand says, if impact & severe damage is sustained. (but inexplicably, not in respect of the Auckland Anniversary Regatta Day sinking of Classic Yacht Gypsy & injury of crew by motoring yacht Antaeus referred to in earlier posts.)
