Response 12(b) That there is a body of customary law/practice must surely be evident when it comes to local knowledge of any regular route or occurrence, on land or sea & this is obviously taken into account by individuals in any risk assessment with or without a rule book to go by. Immediately the ferry turned in the Appellant’s direction in the vicinity of Sth Motuihe, he would be entitled to believe this Roll on Roll off ferry was heading to Auckland via Nth Browns Island & not to Halfmoon Bay which is a destination for other vehicular ferries. The Appellant has been familiar with this territory since 1956 when he was stationed on Motuihe during his Naval training & recreationally/commercially ever since – especially over the previous several weeks before the alleged incident when Classique’s trips on Saturday mornings from her mooring to the lee of local islands for repairs & maintenance, co-incided with the ferry’s usual passage around Browns Island to Auckland.

Motuihe Island today has had all traces of HMNZ Tamiki removed except the water tower & a historic cemetery at the Nth Eastern headland. As a reminder of its illustrious history, a photograpic & written display has been erected
at the approaches.
