The Appellant (Bolton) seeks to respond to the Crown submissions
Response 20 continuing with (d) More inconsistencies regarding the 3 or 4 series of blasts, that M Pigneyguy said he made but couldn’t have made in 10 seconds as from 80 mtrs, are given in his trial evidence – the 1st series at the taking of Photo 1 (about 925 mtrs) & the 2nd series at Photo 2 (about462 mtrs)
(e) Inconsistencies between M Pigneyguy’s evidence and Phillip Sweetman’s sworn statement occur in the copying of the data at the end of the day of the incident when Phillip Sweetman swears that the “point of Incident” is his “1st point of observation” where he places himself at the top of Browns Island – misinterpreting the data he is copying.
(f) Inconsistencies in Barry Young’s evidence regarding the ferry’s maneuverability & construction – in his Brief of Evidence Page 5 he states “Heavy vessels like Seaway can be difficult & slow to turn or stop in an emergency” and Page 7 “It is difficult for any vessel to steer & maintain an exact course, particularly a flat bottomed vessel such as Seaway” but in Trans Page 165 he states “ it’s very fortunate that the ferry has 4 large propellers and is very efficient at stopping in a fairly short distance.” & M Pigneyguy states in Trans Page 9 “The ferry is a catamaran – she has 2 hulls – she isn’t flatbottomed at all – 2 engines & propellers in each hull” and Trans Page 10 “She’s very maneuverable & can stop quickly with the 4 engines”
