Crown Law on behalf of Maritime New Zealand wrote in their Submission Paragraph 23 (c) & (d)
(c) : “The point regarding the alleged 11 degree deviation was further put to and rejected by Barry Young”
(d) : Mr Bolton was also cross-examined on the purported deviation”
The Appellant (Bolton) seeks to respond to the Crown submission –
Responses to Paragraph 23 c & d –
Response 23(c) Barry Young admitted the amount of turning to be 2.4 deg between Photos 1 & 3 without taking into account the turning prior to which would have been 11 deg from the 286 deg course or 37 deg from its course to Sth Motuihe from Kennedy Point Waiheke.
Response 23(d) At Photo 1, the relative bearing between the vessels is down to about 1 deg and by Photo 2 it is zero even though the ferry has turned above the position where Classique was in Photo 1. If the ferry had kept a straight course from Sth Motuihe, Classique would have been well to the ferry’s Starboard bow by Photo 2 with a clearance of 463 mtrs at Photo 3 where M Pigneyguy would’ve had more than adequate safety. Barry Young would have accepted that safe passing (Trans Page 202), as Classique was all ready ahead of the ferry at Photo 2 therefore not on the ferry’s Port side to be covered by Rule 22.15. Consequently Rule 22.17 doesn’t apply and the ferry can freely turn to Port.

Note in addition to the above –
M Pigneguy’s reliance on his use of a Relative Bearing to determine Risk of Collision is entirely negated when he failed to steer a straight course.
