Appellant’s Submissions in response to Submissions of Crown Law Mark Davies, Meredith Connell in opposition to Appeal against Conviction

Crown Law on behalf of Maritime New Zealand wrote in their Submission Paragraph 30 (b)
“ In addition, Mr Bolton himself accepted in his interview that Classique was the give-way vessel and that he knew the ferry was obligated to maintain its course and speed. In effect he said he kept going because of his assumption that the ferry was heading to Auckland and based on his use of his ‘Rule of thumb’ therefore he concluded he did not need to change his own course. In evidence too, the appellant accepted that if there was a risk of collision between the two vessels then Classique was obliged to keep out of the way”
The Appellant (Bolton) seeks to respond to the Crown submission …
Response to Paragraph 30(b )– (again Yeah right ! Plain BS)
“In addition, the Appellant did not accept at the Interview that he was the give-way vessel in the incident 14th Mar’09 – this reference by Crown Law is taken out of context from Page 13 of the Interview when the Appellant is discussing a hypothetical situation put to him by Ian Howden – “…if you’ve got a crossing … with risk of collision …?” Again Crown Law has taken a reference in Transcripts Page 244 line 24 out of context by saying the Appellant accepted Classique was obliged to keep out of the way – the Appellant is being told by Crown Law that “assuming there is a crossing with risk of collision…that’s Classique isn’t it ?”

Bolton’s rule of thumb or Line of Sight method of determining Risk of Collision
is so accurate it can be called “Infallible”- It is used in missile guidance systems
Barry Young foolishly denigrated it because he didn’t know how it worked
& said it wasn’t taught when it was, in the very Maritime School he said he worked at.
