Response to Paragraph Response 32. Part (a) … The Appellant has held since the 1970s, an inshore commercial master’s ticket and Navigational Qualifications both Celestial & Coastal, has trained many hundreds of crew both coastwise & offshore, chartered in America’s Cups Fremantle & San Diego, sailed Classique via Cape Horn to charter in the Caribbean, completing a circumnavigation upon return to NZ in time for our Millennium & America’s Cups.
• For the Judge who has met the Appellant only during these hearings to suggest that the Appellant’s evidence is unreliable, can be compared with the opinion of a man the Appellant began sailing with in Auckland A Division Racing on his renown yacht Fidelis back in the 1970s & who subsequently sailed offshore to the Kermadecs with the Appellant onboard Classique a few years ago – this man is a respected & nautically experienced Queens Council (retired) whose affidavit filed 17th March 2011 said “That I’ve known Mel Bolton for many years and that I regard him as an excellent yachtsman and a man of integrity” “That Mel Bolton is a well known yachtsman particularly in the Hauraki Gulf and is a living legend in his own right. I’m aware that he has circumnavigated the world and that he made a legendary voyage alone from the Atlantic back to Auckland” “That for my part Mel Bolton is a man of great courage and nautical skill” “That in my many years of boating on the Auckland Harbour, I have never heard of a prosecution being brought in the circumstances of the instant case. I find the actions of the skipper of the ferry somewhat bizarre and I believe the whole prosecution has been an example of overkill”
