Response to Paragraph 32 Part (b)
• Judge Davis’s opinion of the Appellant can also be compared with that of Julian Joy whose Expert Report the Appellant applied to be allowed to produce at a Rehearing –Julian Joy also fully confirms the validity of the Appellant’s evidence -.
“I, Julian Gilbert Joy, have read and understand the protocols relating to giving evidence as an expert witness, as defined in the Code of Conduct for Expert Witnesses‘.
I am 63 years old, born in Auckland, and am qualified to give evidence in this matter as I have a B.Sc from Plymouth England, majoring in Navigation and Shipping Business, a first Mate Foreign Going certificate from London England, and an Inshore Launch Master certificate from Auckland. I am currently employed full time as a Senior Lecturer at the New Zealand Maritime School. I am a Gazetted examiner for some Maritime New Zealand certificates, and also for radio operator licences. I have sailed in the Auckland area many times, and have been involved in training ships‘ officers in several Pacific nations.”
Clearly, where the Appellant’s evidence & that of Julian Joy contradicted that of the prosecution’s, there was valid reason – it is that which gives rise to this Appeal.

Julian Joy has higher qualifications than Barry Young the purported Expert Witness who disregarded his Code of Conduct, swearing to be primarily of help to the Court & acted as a Hired Gun for Maritime New Zealand’s nefarious case.
