Crown Law on behalf of Maritime New Zealand wrote in their Submission, Paragraph 33
“His Honour further dismissed Mr Bolton’s allegations that there was a conspiracy by members in the maritime fraternity to prosecute him…”

Response to Paragraph 33 (d) (e) & (f)
(d) There is also in the Court files, a copy of the trespass notice issued 2008 by Phillip Wardale manager of Bayswater Marina to keep Classique away from the Public Dock -this is in violation of the Marina’s Resource Consents for yachts moored outside.
Phillip Wardale was “not wanting to be seen by his Chartering berth holders, as assisting Classique”
He personally dissuaded crew waiting on the dock, from sailing on Classique
(e) The Zooming of Photo 3, creating an illusion of proximity, by M Pigneyguy, was admitted to in Trans Page 24. These are facts which cannot be rejected.
(f) TAIC was not notified, it is submitted, because of the suspect motive of the Claim – a proper TAIC investigation of the incident would not have proceeded to prosecution taking advantage of Appellant’s self representation & the Judge’s nautical unfamiliarity.

Not only was this evidence presented to Judge Davis as to the relationship between Keith Ingram, Phillip Wardale, M Pigneguy & Ian Howden but Keith Ingram & Phillip Wardale were subpoenaed to appear in Court to be cross- examined by Bolton to verify the evidence about their collaboration. Keith Ingram wrote a letter asking to be excused & Phillip Wardale was told by Crown Law to go home after he’d waited a while to be called.
