Crown Law on behalf of Maritime New Zealand wrote in their Submission, Paragraph 34
“Mr Bolton also submits that Judge Davis failed to take into account his position that special circumstances existed such that he did not have to comply with the ordinary give way rules. However, as he himself confirmed in evidence, the “special circumstance” he relied upon was his assumption that the Seaway was going to turn to port (based on his understanding of its usual course)”

Response 34. There were 3 reasons to consider that Special circumstances applied
(a) The shallow water in the proximity of Browns Island light & reef – Trans Page 208
(b) The ferry deviating from its Regular Run – Trans Pages 231- 236
(c) The incremental turning of the ferry towards Classique. B Young – Trans Page 192
(M Pigneyguy refers to the shallows at Browns Light in his Addendum & Trans Page 6)

Note in addition to the above Response to Paragraph 34 …
Considering Crown Law is representing Maritime New Zealand in this case, it reveals the incredible dishonesty going on between these two state services. Ian Howden for Maritime New Zealand & Mark Davies for Crown Law are the two individuals heading the case perpetrated by these two State Services which are both subject to the jurisdiction of the Ombudsman who will be expected to take an interest in this totally unacceptable behavior entirely disregarding the Codes of Conduct they have sworn to uphold.
