Crown Law on behalf of Maritime New Zealand wrote in their Submission, Paragraph 43 …
43 : “It is submitted that it is evident from Judge Davis’s recitation of the facts in his reserved decision, that he accepted Mr Pigneguy’s evidence on this issue. In addition, it is difficult to see how this issue is of any real relevance to the core determination for the Court, that of which vessel was obliged in the circumstances to give way. Irrespective of this, Judge Davis, nonetheless heard the evidence on the point and clearly preferred that of Mr Pigneguy.”

Response to Paragraph 43
Response 43. It is submitted that M Pigneyguy is not entitled to operate outside the mandatory requirement of Collision Regulations or suggest to the Judge that he may. The relevant issue of obligatory signaling is at the core of the Rules governing the safe passage of vessels and violated by M Pigneyguy

Crown Law, Mark Davies is writing his submission
on behalf of and with the information supplied by Maritime New Zealand, Ian Howden.
It is incredible that he can even keep a straight face in Court when he puts such obvious rubbish before it.
He is saying that M Pigneguy’s evidence regarding sounding an insignificant, non complying, handheld aerosol hooter at 80 mtrs off is not relevant to the core issue for determination.
Of course it is an essential issue and a prime violation of Maritime Rules by M Pigneguy for an approaching vessel.
