In the Court of Appeal
the three judges made specific reference to the consequences of
the amateurish investigation that had led to the charges being laid
“Before us Mr La Hood for the Crown accepted that
there was no actual risk to the ship or its passengers as
a consequence of the gash in question. In our assessment
this was not the original approach of the Crown [Maritime
NZ]. which embarked on the trial on the basis that Mr
Henderson’s actions had caused actual risk or danger:
It was driven to this concession by the evidence as it unfolded in the District Court. “
EXPECT TO BE ACCUSED OF BEING A LIAR AND A PERJURER
One of the most inept aspects of the investigation was the Investigator’s failure to interview the mate/master who took over command from me on the return voyage from Wellington to Picton.
He made his own inspection of the hull from the wharf and he also didn’t detect the damage. When I told the jury about that inspection the prosecutors accused me of lying.
Fortunately my lawyers had taken a signed statement from the mate/master which detailed the inspection he had made and that statement was shown to the jury.
A second allegation that I was giving perjured evidence arose in relation to a video reconstruction of the post-collision inspection of Santa Regina on the night that Alan Radcliffe and I had undertaken. This assumed considerable importance because the jury specifically asked the question whether Alan agreed that my video of the inspection was a correct reconstruction. Continuing …
