“Alan (Radcliffe) was to have been a prosecution witness and would
have been able to verify the reconstruction. However, when we
got to trial there was no sign of Alan. He was at sea on board
Tangaroa and was unable to help me. How convenient for the
prosecution.
it turned out that four months prior to the scheduled trial, Alan
had informed Maritime NZ that he wouldn’t be available for the
March date. Unfortunately for Maritime NZ, NIWA agreed to
stream the video to Alan at sea on Tangaroa — 90 nautical miles
off the Canterbury coast — and we got a written statement from
him via satellite confirming that my video reconstruction was
accurate. In fact, Alan commented that he felt our inspection was
longer than that reconstructed for the video.
But this had not stopped the prosecutors from alleging that
my reconstruction was a bogus “gilding of the lily” which I had
made up to impress the jury. In other words, a second baseless
allegation that l had perjured myself in the witness box.
It disgusts me that the Court system allows a prosecutor to
make allegations of perjury which have absolutely no factual
basis and which would have been disproved had Maritime NZ’s
investigation been conducted competently.
DON’T EXPECT ANY IMPARTIAL REVIEW OF THE CASE
AFTER A PROSECUTION IS 
STARTED
Under the Solicitor General’s rules for prosecutions, prosecutors
are supposed to keep an open mind and to review the case if new
evidence comes to light or if things change. It became apparent
to us when the briefs of evidence were filed ahead of the trial that
the Maritime NZ case was extraordinarily weak.” Continues …
