His story resumes …
“My lawyers had briefed New Zealand’s leading naval architect,
Harry Stronach and the well-respected ex ferry master Captain
John Brown.
Stronach assessed the implications of the undetected damaged
plating which left an opening with a cross section of about 0.14
square metres that would have allowed water to enter that high
up the ship only in extreme sea conditions.
He concluded:
• The ship had drainage and pumping arrangements that
could handle water volumes considerably in excess of any
conceivable water ingress through the damaged area;
• Santa Regina could handle damage scenarios where the
openings in the shell plating were several hundred times larger
than the observed damage;
• There was no risk of water on the vehicle deck causing a free
surface effect;
• Other similar ships (including Kairaki and Srraitsman have
permanent large ventilation openings in locations similar to the
area of damage on Santa Regina;
• The observed damage did not compromise the structural
integrity of the ship or present any risk to passengers or crew;
• Maritime NZ’s so-called “expert witness” conceded that he did
not have Stronach’s experience, expertise or qualifications to
argue against the above.
Stronach‘s evidence concluded:
“The allegation that confirmed operation of the ship
endangered the passengers and crew: is not supported by
an analysis of the facts” [emphasis added]
My lawyers then decided to approach Keith Manch, requesting
a meeting to review matters. Part of their reasoning was that
this prosecution had been started by Catherine Taylor whose
judgment in legal matters had been proved suspect.
In the Survey Nelson case the Court of Appeal found Taylor had
acted illegally in her treatment of that survey company and its
directors.
