But still the leadership of Maritime NZ was not willing to bury
the hatchet. It launched a second appeal to the Court of Appeal!
PREPARE TO MORTGAGE YOUR HOUSE
The second appeal followed four pre-trial hearings in the
District Court, a six day jury trial, and the first appeal hearing
— accumulating legal costs and experts’ fees of just under
$300,000. l am extremely fortunate that my then employer Strait
Shipping has stood by me throughout this ordeal and has met
the costs of a first-class legal team with extensive experience in
Had that not been the case, the consequence would have been
my ﬁnancial ruin or, more likely, being forced into a position
of pleading Guilty to avoid the huge costs associated with
defending this type of complex case.
By contrast, Maritime NZ as a branch of the Great Ship
of State, has infinite resources at its disposal. In my case this
was exempliﬁed by the retention of two senior prosecutors
and also Maritime NZ commissioning a bizarre “crime scene
reconstruction” which involved a car crash expert shining
torches, car headlights and a Wellington harbour tug spotlight on
to the hull of Santa Regina. That expensive farce was designed
to show what steps I ‘should have‘ taken on the night. But the
reconstruction was done in ﬁne, calm conditions and on the night
of a perigee super moon!
Note in addition to the above …
A value-for-money review in 2010–11 identified a need for Maritime New Zealand to have a clearer picture of where its services are delivered, how much those services cost, and who benefits from them.
