Maritime New Zealand took with alacrity the impossible claim put up by M Pigneguy. They didn’t even check it for feasibility.
It is an incitement of the intelligence of otherwise grown men to consider that it was other than a blatant fabrication with an ulterior motive.
M Pigneguy stated that “after turning at Sth Motuihe, on his track from Waiheke, he saw Classique 2 nmiles away.”
Classique was at Nth Browns Island heading towards an anchorage very close to Sth Motuihe.
M Pigneguy firstly got Classique’s location wrong. He said she was seen 30 degrees on Seaway’s port bow. If anyone checked that, they would have Classique positioned Sth of Browns Island which is ridiculous. The course Classique was on would’ve then had her heading South of the point where Seaway turned at Sth Motuihe & obviously not crossing Seaway’s bow from port to starboard as claimed.
Next M Pigneguy said he maintained a course of 286 degrees True. That was proved wrong by the photographic evidence he took as he approached Classique. His concentration on his photography was responsible for his not checking the course he was steering. It was steadily in the direction of the path Classique was following.
For M Pigneguy to then say that when he was approximately 80 metres away he sounded 5 blasts on his ships whistle should’ve alerted Maritime New Zealand that something was seriously wrong with the claim & it points straight away to M Pigneguy’s own ignorance of Maritime Collision Regulations.
Rule 22.8.1 states that Any action to avoid collision must be … made in ample time and with due regard to the observance of good seafaring practice.
Seaway was travelling at 15.5 knots & would cover 80 mtrs in 10 seconds – each blast is to be of 1 second’s duration & then there’s to be time for Classique to respond.
