Further analysis of the self incriminating claim made by M Pigneguy, pedantic skipper of Waiheke roll on/roll off ferry, accepted by Maritime New Zealand with alacrity, to wrongfully prosecute Bolton, the innocent skipper of yacht Classique
The last part of M Pigneguy’s claim says “ Another 5 blasts on our whistle brought a wave from the yacht’s female helmsperson who was the only person visible on deck”
In reality there was only a couple of fumbled toots from his handheld aerosol & the wave was to acknowledge Seaway’s safe passing astern of Classique.
M Pigneguy was the exchairman of the Auckland Charter Boat Association. His involvement as contributing author with Keith Ingram editor of Professional Skipper Magazine, had gone back prior to 2000.
That’s when Classique’s cost share crew concept began attracting their unfavourable attention. Phillip Wardale exmanager of Bayswater Marina also got in with antagonism on behalf of his Charter Boat berth holders. There was concerted effort pressuring Maritime New Zealand to prosecute Bolton for what they alleged was illegal chartering.
“Roll of Dishonour, Net the Pirates” website was established & Classique was trespassed from Bayswater Marina. This was contrary to the Marina’s Resource consent which stipulated public access was to be given to the yachts moored outside.
This reference by M Pigneguy to the only person visible on deck being the helmsperson, was probably calculated to bring retribution down on Bolton for not being present. Cost share crew, expected in his mind, to be inexperienced but left in a position of responsibility.
There was a section for M Pigneguy to fill in on his claim form – “What in your opinion contributed to the accident?” He wrote “Total ignorance by the helmsperson of the yacht Classique of the Rule of the Road and safety at sea”
This is just another example of M Pigneguy’s half-baked assumptions.
The main steering station with engine controls was naturally in the wheelhouse where Bolton had been in charge & monitoring Seaway’s passage over more than 3 1/2 nmiles, since before it arrived at Sth Motuihe from Waiheke.
Although Maritime New Zealand had been familiar for years, with Classique’s substantial layout – M Pigneguy was allowed to display in Court, his ignorance & many violations of Maritime Regulations.
