Final analysis of the Addendum written by M Pigneguy, pedantic skipper of Waiheke roll on/roll off ferry, accepted by Maritime New Zealand with alacrity, to wrongfully prosecute Bolton, the innocent skipper of yacht Classique
M Pigneguy concludes – “When relieving as Master on the Seaway 2, I frequently have my camera with me to record the actions of other vessels that have little or no understanding of the Rule of the Road, as was clearly the case with the Classique.”
Then he had the temerity to – Declare before Ian Howden, Barrister & Solicitor of the High Court of New Zealand that “I Michael Pigneguy of Auckland solemnly and sincerely declare that the information in the attached Maritime New Zealand Incident Report, is true by virtue of the Oaths and Declarations Act 1957.”
Very conveniently Ian Howden, Investigator for Maritime New Zealand becomes a Barrister & Solicitor who should’ve known better.
This circus appears like – The Blind leading the Blind.
“Those lacking the skills or knowledge for something are being guided by equally inept individuals.” That extends to Ian Howden & M Pigneguy leading Judge Davis astray – he at least admitted to having no Nautical Knowledge.
Both Ian Howden & Michael Pigneguy are gulilty of sins of Omission & Commission. Both purport to know & practice Maritime Collision Regulations but it was M Pigneguy’s multitude of Violations which created his intended incident.His blatant omitting to tell the true situation amounts to absolute perjury along with the untruths he wrote & spoke. Ian Howden also offended by countersigning a Declaration he knew to be false or improper in all essential details.
For M Pigneguy to be using his camera instead of the required complying Ships Whistle at the appropriate times & distances off is a clear admission of his ignorance of the Rule of the Road at Sea.
To be unable to steer straight or check his course is clearly an indication that he is acting as a pedantic menace on the harbour & is unfit to hold a relieving skipper’s position.
