Defence expert Julian Joy’s Second Report for Court in response to Affidavit of Mr Young and Crown submissions.
And Reserved Decision of His Honour Judge Davis Ruling in Respect of the Prosecution MNZ v. Mel Bolton

Introduction
Although I sincerely respect and accept His Honour Judge Davis’ determination and ruling, in particular that the application for rehearing is declined, nevertheless for personal professional reasons I cannot permit certain matters to go unchallenged and so I respectfully here respond briefly to these matters so they may be recorded for the record on the court file.
In this paper I have therefore responded to matters in the following three documents:
1. Affidavit of Morton Barry Young in response to my report
2. Submissions of Counsel Mark Davies Meredith Connell for Maritime New Zealand in opposition to application for rehearing.
3. Reserved Judgement of Judge Davis dated 27 May 2011 declining application for rehearing.
In doing so where necessary I have referred to my own document:
“Classique” and “Seaway II” Hauraki Gulf, Auckland; Investigation and Review of Evidence.
My response to Affidavit of Morton Barry Young
In Mr Young’s affidavit, paragraph 11, Mr Young reiterates his assertion that the close quarters situation was not caused by Seaway II turning to starboard. However the photos prove Seaway II did turn progressively to starboard, as he agrees in his Paragraph 14(c).
In Mr Young’s affidavit Paragraphs 12 & 13, Mr Young states “…using Mr Joy’s own figures and pictures….” and that “…at the time of the incident, neither Mr Pigneguy nor Mr Bolton had access to these high quality photographs…..”.
I point out that the three photos referred to by all parties in all our evidence are those taken by Mr Pigneguy, and clearly no-one had those photos except Mr Pigneguy until they were subsequently presented by him to Maritime New Zealand with his report. Therefore the purpose and meaning of these two paragraphs by Mr Young is unclear. Continues …
