• His Honour Judge Davis while reserving his position on the Rehearing Application invited Defence Counsel to provide affldavit evidence of an expert the Defence seek to recall.
The Defence filed a report from Expert Julian Joy.
• Hls Honour made a ruling having considered the report of Mr Julian Joy that he was unwilling to grant a rehearing.
• Although we must for the purposes of this hearing accept His Honour’s rullng, Mr Joy felt that he was unwilling to grant a rehearing.
• Although we must for the purposes of this hearing accept His Honours ruling
Mr Joy felt compelled professionally to respond to the matters raised by expert Mr Young, Crown Counsel and he is filing a Second Report in response
• We accept His Honour has determined that the expert evidence does not take matters any further and we must be bound by that.
• Nevertheless In the application that we originally made I did refer to other evidence in other matters that may have resulted in a miscarriage of justice.
• In that respect we are inviting Your Honour to rehear the matter on grounds other than in relation to the expert. We understand there is no jurisdictional bar to making a second application for rehearing. (Melekato Pulu v. Department of Labour. Judge Graham at Auckland.)
