“Pointing out that Mr Joy was not a witness to the events that occurred on the Hauraki Gulf , Judge Davis held that Mr Joy’s evidence was, in many respects, premised on his own attempts to reconstruct the relative positions of Classique and Seaway II based on photographs tendered in evidence. He (Judge Davis) considered it was not possible to determine the precise position along the path Seaway II was undertaking at the time of the incident.
Bolton writes a Submission Appealing such distorted Judicial thinking
“Julian Joy was not a witness to the events, neither was Barry Young. Judge Davis was mislead to believe that a precise position could not be determined – it is a common navigational practice wrongly denied by Barry Young.”
Note in addition to the above Submission …
Here is evidence of both Judges not being familiar with the technicalities of Navigational practice. It is also showing how they both were mislead by Barry Young’s dishonest evidence given as the Hired Gun employed by Maritime New Zealand to pervert the course of Justice in a District Court instead of before TAIC – Transport Accident Investigation Commission.
It should have been obvious to both Judges that the only persons witness to the event were those onboard Classique & Seaway – excluding quite clearly Barry Young & Julian Joy.
All Barry Young’s evidence was “premised on his own attempts to reconstruct the relative positions of Classique and Seaway II based on photographs tendered in evidence.”
Quoting from above – “He (Judge Davis) considered it was not possible to determine the precise position along the path Seaway II was undertaking at the time of the incident.”
Judge Davis only had this consideration because Barry Young said in his deliberately misleading evidence that “it was not possible to determine the precise position along the path Seaway II was undertaking at the time of the incident.”
