He makes up a story to pad out his deficient decision …
“The appellant said that the status hearing Judge told him he could place some reliance on the evidence to be given by Maritime New Zealand’s expert on the basis that the expert was independent and his evidence would be intended to assist the Court.
It is now said on behalf of the appellant that this dissuaded him from seeking to call his own expert.”
Bolton writes a Submission Appealing Judge Toogood’s Decision …
“The Appellant was told several times by Judge Davis (Not the Status hearing Judge) to rely on the status of Barry Young as an independent witness to whom technical points could be addressed – that should have been the case but Barry Young betrayed that trust by erring severely from his role of expected assistance to the Court..”
Note in addition to the above submission …
The Appellant, Bolton didn’t discuss at the status hearing, the topic of reliance upon Maritime New Zealand’s expert Barry Young.
Bolton knew at that time that the evidence regarding M Pigneguy’s claim put up by Maritime New Zealand which Barry Young was later employed to support, was false, faulty and indicating M Pigneguy was the violator of all Maritime Collision Regulations.
The status hearing Judge had nothing to say about whether Bolton called his own expert or not.
It was appreciated by Bolton at that status hearing, that Judge Simpson made an order for Maritime New Zealand to have a meeting with Bolton to resolve the matter and not waste further Court time with proceeding to an unfeasible prosecution. Barry Young, who was not known at that time, was first introduced to Bolton at that subsequent meeting ,reluctantly held by Maritime New Zealand, with no intention of resolving the matter.
