Judge Toogood Doesn’t Understand Reason For Robustness
“Mr Joy’s reports are highly critical of Mr Young, to the extent of accusing him of acting unprofessionally and misleading the Court. He is critical of the Judge’s findings of fact; and he extends his criticism to Maritime New Zealand for failing to meet appropriate professional standards in the conduct of its investigation. Although Mr Joy certified that he had read and understood the protocols required of an expert witness, it is arguable that he lacked the independence and objectivity the Code of Conduct for Expert Witnesses requires, and that the partisan nature of his approach meant that his evidence would not be substantially helpful to the Court. I note, however, that Judge Davis did not rule it out on that basis when he came to consider the rehearing application.”
Bolton writes a Submission Appealing Judge Toogood’s Decision ..
“It should also be appreciated that Julian Joy’s emphasis on the facts is made robustly.
Consequently the Court could be assisted by the Report’s revelation of professional misconduct on the part of Maritime New Zealand, M Pigneyguy and Barry Young Young”

Judge Toogood is not so good at engaging his thinking gear.
Julian Joy, more senior in qualifications than Barry Young, employed at the same NZ Maritime School, has obvious reason to expose the deceit & unprofessional conduct of the Maritime New Zealand prosecution.
Both Julian Joy & Barry Young signed the Code of Conduct governing Expert Witnesses. Their primary duty is to be of assistance to the Court. Julian Joy delivers vitally important evidence to the Court revealing the dishonesty & misleading of the Court perpetrated by Barry Young as a Hired Gun. Mr Joy was completely independent & objective in his accurate Navigational evidence.
Judge Toogood was completely outside of his field of expertise & was the wrong man to be presiding over this Nautically technical case.
