Judge Toogood, for no good reason would not allow Bolton to include Julian Joy’s reports as corroborating evidence in his Appeal against the irresponsible & ill-informed Decision of Judge Davis.
The following is the preparation for Bolton’s Appeal of that Decision by Judge Davis.
Each paragraph begins with a précis of the salient point Judge Davis makes which indicates his misunderstanding or error.
Then comes the correction & explanation in inverted commas.
Para 7 : Bolton was not visible on deck….
“Mr Bolton was in the wheelhouse, near the controls & responsible for navigation, observing the ferry as it headed from Sth Motuihe towards Browns Island – as separation of vessels decreased from 2 to 1 nautical miles “ (1 nm = 1850 metres)
Para 9 : The course of 286 True is said to be to the conspicuous building on Nth Shore ….
“The course of 286T would take the ferry to a point 6 degrees South of that building.”
Para 10 : The ferry heading towards the Conspic Building was not on a course of 286T…
“The ferry approached Motuihe from Waiheke on a course of 260T. After rounding Sth Motuihe a course of 286T was initially reached but the ferry had turned to 292T at the point of the taking of the 1st photograph & began heading towards the Conspic Building.”
Para 11 : Classique was approaching Seaway on a 30 deg angle & a Crossing situation could have developed….
“At that stage the situation developing was such that if each vessel keeps its course & speed, each shall pass clear of the other. (Toghill – International Colregs Rule 18) A border line Head-on/Crossing situation – both passing Starboard to Starboard – because no risk existed it doesn’t fall within Rules regarding Crossing where Risk exists.”
