Para 33 A & B : For the overall benefit of the Auckland boating public, the defense mounted by Mr Bolton must succeed – he understood the applicable Maritime Rules in this situation.
The only explanation for this complaint to have been artificially created & for the prosecution to have been instigated has as its foundation the long term dissatisfaction with Classique’s Co-operative Cost share Crewing Concept & the antagonism of M Pigneyguy towards recreational boaters for whom he carries a camera to record the action of those ignorant of the Rules of the Nautical Road – according to his Addendum.
The Judge refers to “conspirators” but is in error as to the witnesses for the prosecution not knowing them.
M Pigneyguy is employed by Keith Ingram, editor of “The Professional Skipper Magazine” as a contributor of many years standing. Keith Ingram & Phillip Wardale ex-manager of Bayswater Marina have both been harassing/co-operating with Maritime New Zealand to police my crews over the past 10 years.
As a result of MNZ not finding any infringement, Keith Ingram has maintained Classique as its raison d’etre in the Roll of Dishonour on its Net the Pirates web site since 2006 & Phillip Wardale in contravention of the Marina’s Resource Consent, trespassed Classique & her dinghy in 2008 from the marina’s public dock.
The emails between all parties including Harbourmaster staff & MNZ director Wellington, disclosed in the prosecution documents contain relevant references to their opinions in this matter to the extent they become the “Public Interest” given as the reason for this prosecution – according to C Taylor Director MNZ.
Barry Young was employed by Auckland Maritime School as a lecturer & was simultaneously contracting his services to Maritime New Zealand. Correction to Paragraph C & D follows …
